State Trademarks

State trademark registrations are essentially a recordation of a common law mark. Since state trademark registrations are not examined, they do not generally offer any greater protections than the mark owner already had under common law. Similar to a pure common law mark, state-registered marks are not entitled to the presumptions of validity, distinctiveness, or ownership which are inherent in federal trademarks.
