Patent Infringement Matters

Infringement occurs when every element of any one valid patent claim is found in an accused technology. Only claims can be infringed. The claims are interpreted in view of the written description; however, if subject matter is included in the written description but left out of the claims then the patentee has no property right in that subject matter.
